US Supreme Court Rejects Amazon Sales Tax Case
(RTTNews) - The US Supreme Court Monday declined to get involved in the billion-dollar fight between states and online retailers over the collection of sales tax.
The Court, without any explanations, rejected appeals by online retailers Amazon.Com Inc. (AMZN) and Overstock.com Inc. (OSTK) against a New York State law that demands sales tax to be collected despite the companies not having any facilities in the state. The online retailers were appealing against the ruling of New York's top court, which upheld the state law.
Amazon has no offices or warehouses in New York, and online retailers usually do not collect sales tax in these states. However the New York Court of Appeals said that Amazon can be considered to have physical presence as it uses "in-state affiliates."
